General Conditions of Sale
Applicability
These General Conditions of Sale ("Conditions") govern all sales of youth baseball coaching plans and related digital products ("Products") by 8020BASEBALL LLC, an Idaho limited liability company, to the customer ("Customer") through our website or other sales channels, unless otherwise agreed in writing.
License and Use
Upon purchase, Customer is granted a non-exclusive, non-transferable license to use the Products solely for coaching youth baseball teams. Products may not be reproduced, distributed, resold, shared outside authorized users, or used for any other purpose without prior written consent from 8020BASEBALL LLC.
Authorized Access (Group Sales)
Access to Products sold to a group is granted only to the specific email addresses submitted to Coach Bo and approved by 8020BASEBALL LLC. Access will not be granted to any other email address.
Customer may not add, transfer, forward, or share login credentials or Product files with any person whose email address was not submitted to Coach Bo and approved by 8020BASEBALL LLC.
8020BASEBALL LLC may revoke access immediately if an unauthorized email address, shared login, or unapproved distribution is discovered.
Access Term
Authorized access is valid for one (1) full year beginning on the date access is first granted to the approved email address. Access expires automatically at the end of that one-year period unless 8020BASEBALL LLC issues a written renewal.
Expiration of access does not grant any right to copies, downloads, or continued use of the Products.
Assumption of Risk and No Responsibility for Injury
Baseball and all related training, drills, throwing, hitting, fielding, running, and coaching activities carry an inherent risk of injury. Customer and all authorized users assume all risk of injury, illness, property damage, and other harm that may occur while using the Products or applying any coaching plan, drill, or instruction.
8020BASEBALL LLC, Coach Bo, and their officers, members, employees, and agents have no responsibility for any injury, accident, medical cost, or other harm arising from use of the Products. Customer is solely responsible for safe implementation, proper supervision of players, age-appropriate activity selection, and compliance with all applicable league, school, and safety rules.
The Products are educational coaching materials only. They are not a substitute for in-person medical advice, certified athletic training, or on-field safety judgment.
Limitation of Liability
To the fullest extent permitted by law, 8020BASEBALL LLC shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, or for any injuries incurred while using any Product. This includes damages arising from use of, inability to use, or reliance on the Products.
Total liability of 8020BASEBALL LLC, if any is found despite these Conditions, shall not exceed the amount paid by the Customer for the Products.
Intellectual Property
All Products, including content, designs, and materials, are the intellectual property of 8020BASEBALL LLC. Unauthorized use or reproduction is prohibited.
Payment Terms
Payment is due in full at the time of purchase unless otherwise specified. All prices are in U.S. dollars and exclude applicable taxes, which are the Customer’s responsibility.
Governing Law
These Conditions and all transactions are governed by the laws of the State of Idaho, USA, without regard to conflict of law principles.
Modification
8020BASEBALL LLC reserves the right to modify these Conditions at any time. Updated terms will apply to subsequent purchases. Existing one-year access grants remain subject to the Conditions in effect on the date access was granted, except where a change is required by law.
